Frequently asked questions

Is the SME fine the lower or the higher amount?

The lower. Article 99(6) says that for SMEs, including startups, each fine is up to the percentage or the fixed amount, whichever is lower. For other companies it is whichever is higher.

Which fine tier covers Article 50 breaches?

Article 99(4): up to €15 million or 3% of worldwide annual turnover. For an SME or startup, the lower of the two, which for most startups is the percentage. With €2m turnover that is 3% of €2m, €60,000.

Is the percentage of EU revenue or worldwide turnover?

Worldwide. Article 99 uses total worldwide annual turnover for the preceding financial year. A small European entity inside a large group should not assume only its own figures count.

Will the fine be the maximum?

The maximum is a ceiling, not a likely fine. Under Article 99(7) authorities weigh the nature, gravity and duration of the breach, intent or negligence, mitigation, cooperation and the size of the operator, among other factors.
